Wedding Contract
WEDDING PHOTOGRAPHY - CONTRACT and TERMS & CONDITIONS
1. This Contract is between Rebecca Fairman and Calum Worrall, and Tess Viera Photography of Lime Avenue, Derby, to supply Wedding Photography on 13/09/2025, the selected package is ‘Every Bit of It’ priced at £2000.
2. Starting at 12:00pm with the Ceremony to be held at Our Lady & St Joseph’s Church, 1 St Joseph's St, Matlock DE4 3NG and Reception to be held at The Maynard, Main Rd, Grindleford, Hope Valley S32 2HE. The Photographer will arrive at the location of bride or groom preparation (The Maynard, Main Rd, Grindleford, Hope Valley S32 2HE) for wedding preparation shots at a time 9:30am.
3. Scope of Work
Photographer shall provide photography services for Bride and Groom consisting of:
Mini shoot or Venue Visit - 1-2hr photoshoot (50 digital images)
Bride preparations and pre-wedding celebrations
Ceremony
Couple shots on Location (Padley Gorge)
Group shots
Reception until 30 minutes after first dance
Preview images within 2 days of event
Beautifully packaged USB Memory stick of 400+ digital images (edited)

4. Refreshment for Photographer/s
It is requested that a meal be provided by Client for Photographer/s for events 5 hours or longer. Photographer additionally requests to be seated at a table where frequent standing up, moving around, and sitting down in order to capture moments as they occur will not be a distraction, this could be a separate room to guests, but close by so as not to miss anything. It is important that the Photographer eats when the bridal party eats, so as to ensure no missed moments on the day. Drinks refreshments will be bought by photographer.
5. Harassment
Photographer defines harassment as experiencing any inappropriate, threatening, hostile, or offensive behaviour from any guests or other person at the wedding. If harassment takes place at an event the Photographer would notify the planner or bride and groom, ask the guest to leave if it continues, and leave the event on the third offence.
6. Fees
Tess Viera Photography shall provide photography services described above for the fee of £2000 (Two Thousand Pounds).
Bride & Groom agree to pay to Tess Viera Photography a booking retainer of £300 (Three Hundred Pounds) no later than Monday 27/01/2025.
Bride & Groom agree to pay remaining balance of £1700 (One Thousand, Seven Hundred Pounds) in 4 instalment payments of £425 (Four Hundred and Twenty-Five Pounds) and any additional expenses as described in clause 7 below, on the following dates:
Booking retainer £300 - 27th Jan 2025
Instalment 1: £425 - 1st March 2025
Instalment 2: £425 - 26th April 2025
Instalment 3: £425 - 14th June 2025
Instalment 4: £425 16th August 2025
In the event that the wedding is postponed by Bride & Groom for any reason, any payment made up to point of postponement will be held by the Photographer until a new date can be re-arranged.
In the event that the wedding is cancelled by Bride & Groom for any reason, Bride & Groom agree to forego return of any payments made to date of cancellation.
All prices are as at the time of signing the Contract, but in the event that changes arise that are outside the Photographer’s control, for instance but not exclusively, the costs of Prints, Additions, Travel and Maintenance, then the Photographer will inform the Client of such within 21 days.
7. Additional Expenses
No additional expenses are due for this event.
8. Display & Non-Usage Fee
The Photographer may display any photographs included in this contract in their studio, website, portfolio, literature, display areas, exhibitions, competitions, advertising, social media or slide shows.
The use of photographs by the Photographer can commence immediately after edited images have been confirmed delivered to the Client.
If you would prefer your images not to be used by the Photographer for marketing and promotion purposes a Non-usage Fee is in place.
This is a fee of 15% of the total amount due for photography coverage. This fee is to off-set the loss of marketing opportunities. This would be £300.00.
Please contact the Photographer if you would like to arrange a Non-usage payment and the Photographer will send you an invoice for 15% of the total amount due for photography coverage.
9. Retouching/Reorders/Copyright/Creative Licence
The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to irregular reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.
Any retouching, digital manipulation and artist finishing that is not included in the original package is available to the Client as an optional extra.
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of the Photographer in writing. Negatives/Digital files remain the property of the Photographer.
The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The style and the number of photographs are also dependant on unexpected change of the weather and the availability and willingness of the clients and their guests. The Photographer will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.
Tess Viera Photography retains full copyright over all photographs.
10. Licensed Images/Third Party Printing
Images applied by us on a USB Memory Stick as High Resolution jpeg format digital files. They are licensed to you for sharing or displaying electronically with Family and Friends, and for printing by the Bride & Groom ONLY. Image files must NOT be copied, altered or sold in any way whatsoever.
Tess Viera Photography cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced from the USB Memory Stick that is supplied by Third Party Printers such as High Street photo processing shops.
11. Attendance
In the unlikely event of the assigned Photographer being unable to attend your wedding due to unforeseen circumstances, the Photographer reserves the right to appoint another Photographer to attend your wedding on your behalf to undertake the wedding photography to his/her best ability.
12. Cancellation/Limitation of Liability/Force Majeure
The Client may cancel this contract at any time by giving written notice to the Photographer, but in doing so shall forfeit any monies paid. In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
13. Complaints
Any complaints should first be raised by the Client with the Photographer in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers (SWPP) to mediate but only on the basis that its decision shall be final and binding upon both parties.
14. Mini shoot/Venue visit
All clauses also apply to any images taken on Mini shoot/Venue visit.
15. Covid-19
The Photographer will take instruction from up-to-date PPE regulations during your wedding, this may mean not being able to get as close to clients or guests as a photographer usually would, however the Photographer will bring equipment which will facilitate this, such as longer lenses, so as not to impact on the wedding day. With the regulations and restrictions changing all the time, your Photographer will work with you to determine what will be the best course of action on your wedding day.
16. Country of Jurisprudence
This Contract is made under, and subject to, English Law.
