Family Photoshoot Contract
FAMILY PHOTOSHOOT - CONTRACT and TERMS & CONDITIONS
1. This Contract is between CLIENT NAME, and Tess Viera Photography of Vernon Street, Derby, to supply Family Portrait Photography on DATE, priced at £PRICE.
2. Starting at TIME at ADDRESS. The Photographer will arrive at the location of your shoot at TIME.
3. Scope of Work
Photographer shall provide photography services for Client consisting of:
Family Photography Coverage: 1-2 hours
60 Digital images
3 Prints (7x5)
Preview images within 2 days of shoot
Personalised Client Gallery Link
4. Tess Viera Photography retains full copyright over all photographs.
5. It is agreed that the following terms set out the total agreement made between the parties and that no variation or modification of this contract shall be effective unless agreed by both parties in writing.
6. Fees
Tess Viera Photography shall provide photography services described above for the fee of £60 (Sixty Pounds).
Client agrees to pay to Tess Viera Photography a booking retainer of £20 (Twenty Pounds) no later than DATE.
Client agrees to pay remaining balance of £40 (Forty Pounds) and any additional expenses as described in clause 7 below, no later than 2 (two) days before photoshoot date (DATE).
In the event that the photoshoot is cancelled by the Client for any reason, the Client agrees to forego return of the £20 booking retainer.
7. Additional Expenses
No additional expenses are due for this event.
8. Prices
All prices are as at the time of signing the Contract, but in the event that changes arise that are outside the Photographer’s control, for instance but not exclusively, the costs of Prints, Additions, Travel and Maintenance, then the Photographer will inform the Client of such within 21 days.
9. Images
All images sizes are nominal. The Photographer will provide a pleasing colour balance but cannot guarantee exact colour matching owing to irregular reflectance caused by a combination of certain dyes and materials especially man-made fibres. It is sometimes impossible to record on film or digitally the exact colour as seen by the human eye.
10. Creative Licence
The Photographer shall be granted artistic licence in relation to the poses photographed and the locations used. The style and the number of photographs are also dependant on unexpected change of the weather and the availability and willingness of the clients and their guests. The Photographer will make their best effort to honour requested photographs but does not undertake any guarantee for any specific picture nor incorporate any specific background, location or group arrangement.
11. Display & Non-Usage Fee
The Photographer may display any photographs included in this contract in their studio, website, portfolio, literature, display areas, exhibitions, competitions, advertising, social media or slide shows.
The use of photographs by the Photographer can commence immediately after edited images have been confirmed delivered to the Client.
If you would prefer your images not to be used by the Photographer for marketing and promotion purposes a Non-usage Fee is in place.
This is a fee of 15% of the total amount due for photography coverage. This fee is to off-set the loss of marketing opportunities.
Please contact the Photographer if you would like to arrange a Non-usage payment and the Photographer will send you an invoice for 15% of the total amount due for photography coverage.
12. Retouching
Any retouching, digital manipulation and artist finishing that is not included in the original package is available to the Client as an optional extra.
13. Reorders
All reorders shall be treated as an extension of this contract and no responsibility for error will be accepted unless orders are given in writing.
14. Copyright
Any images or copies of images whether stored digitally or otherwise and any computer program including any source or object code, computer files or printed documentation relating to such images are protected by the Copyright and Design Act 1988. It is contrary to the Act to copy or allow to be copied photographically, electronically or by any other means an image created as part of this contract without the permission of the Photographer in writing. Negatives/Digital files remain the property of the Photographer.
15. Licensed Images
Images supplied by Photographer in a Client Gallery as High Resolution jpeg format digital files. They are licensed for the Client to share or display electronically with Family and Friends, and for printing by the Client ONLY. Image files must NOT be copied, altered or sold in any way whatsoever.
16. Third Party Printing
Tess Viera Photography cannot accept any responsibility or liability for colour balance or quality of any Prints reproduced from the USB Memory Stick that is supplied by Third Party Printers such as High Street photo processing shops.
17. Attendance
In the unlikely event of the assigned Photographer being unable to attend your photoshoot due to unforeseen circumstances, the Photographer reserves the right to appoint another Photographer to attend your photoshoot on your behalf to undertake the portrait photography to his/her best ability.
18. Limitation of Liability
In the unlikely event of a total photographic failure or cancellation of this contract by either party or in any other circumstance the liability of one party to the other shall be limited to the total value of the contract. Neither party shall be liable for indirect or consequential loss.
19. Force Majeure
The due performance of this contract is subject to alteration or cancellation by either party owing to any cause beyond their control.
20. Cancellation
The Client may cancel this contract at any time by giving written notice to the Photographer, but in doing so shall forfeit any monies paid.
21. Complaints
Any complaints should first be raised by the Client with the Photographer in writing within 21 days from the date of receipt of images. In the unlikely event of an unresolved complaint the Client may request the Society of Wedding and Portrait Photographers (SWPP) to mediate but only on the basis that its decision shall be final and binding upon both parties.
22. Country of Jurisprudence
This Contract is made under, and subject to, English Law.
23. Covid-19
The Photographer will take instruction from up-to-date PPE regulations during your photoshoot, this may mean not being able to get as close to clients as a photographer usually would, however the Photographer will bring equipment which will facilitate this, such as longer lenses, so as not to impact on the photoshoot. With the regulations and restrictions changing all the time, your Photographer will work with you to determine what will be best course of action on the day of the shoot.
